About this book

This book identifies the role of insurance in a comprehensive system for managing environmental risks at the local, regional and global level. National and international legal instruments regulating environmental protection, especially aspects like pollution, are not precisely reflected in insurance concepts intended to cover environmental risks. As such, there is a need to identify environmental risks and to propose a taxonomy of environmental risks for various types of insurance coverage. The authors refer to the issues of liability in environmental protection, the scope of insurance coverage and comment on specific issues the importance of which has been noticed by the legislator or insurance practice.

 

The book examines these issues horizontally and vertically from various standpoints, focusing on insurance as a means of managing environmental risks. In this regard, it mainly concentrates on (1) identifying and analyzing environmental risks and methods for managing them via private and public instruments, and (2) insuring these risks.

 

The book is intended for all those interested in the field of insurance and environmental risk regimes, including lawyers, academics and legal professionals.

About the editors

Prof. Katarzyna Malinowska (dr hab) is legal counsel with many years of experience in business insurance and professor at the Leon Koźmiński University. She cooperates on an ongoing basis with the Association of Polish Insurance and Reinsurance Brokers and BIPAR. She is author of at least several dozen publications on insurance law, including insurance distribution. She acts as chair of the Polish section of AIDA (International Association of Insurance Law) for the 2018-2020 term and is currently a member of the Board of Directors. She is also an expert of the Risk Management Committee of the International Astronautical Federation, individual member of the International Committee on Space Law and the International Practice Group Leader of postgraduate studies in space entrepreneurship and 'Risk and Property Insurance, at Kozminski University.

Prof. Dorota Maśniak, PhD, DSc (dr hab) is professor at the University of Gdansk, Head of the Insurance Law Laboratory in the Department of Civil Law at the University of Gdansk; legal counsel specializing in insurance law; academic lecturer, trainer of personnel of insurance companies, insurance intermediaries and banks; leading person and co-creator of the interdisciplinary program of studies at the University of Gdansk - Insurance.  She is an author of numerous publications on insurance, civil, financial law; her Phd dissertation concerned ecological insurance.  She acted as chair of the Polish section of AIDA (International Association of Insurance Law) for the 2020-2022 term and is currently a member of the Board of Directors. She is a member of the Scientific Advisory Committee to the Polish Financial Ombudsman in the term 2023-2026. She is an expert in Global Perspectives on Corporate Climate Legal Tactics - IEG Poland (British Institute of International and Comparative Law).
